Джигме Гьятсо (род.1961г.) был арестован отделом по расследованию конкретного уголовного дела - подрыва бомбы в марте 1996 года перед зданием местной администрации, однако даже не по подозрению в соучастии в преступлении, а за свою политическую деятельность, в частности за создание группы «Ассоциация Движения Свободы Тибета», распространение листовок и плакатов про-тибетского толка и проведение в 1992 году демонстрации.
Вплоть до суда, который последовал через шесть месяцев после ареста, Джигме Гьятсо был заключён в тюрьму Гутса, где его систематически пытали в «камере дознания», а в остальное время держали запястья и лодыжки постоянно связанными, добиваясь признаний в совершении преступлений. Джигме Гьятсо был приговорён к 15 годам лишения свободы по обвинению в «организации и предводительстве контр-революционной группы». За более чем 13 лет тюремного заключения Гьятсо несколько раз переводили из одного пенитенциарного заведения в другое, где к нему применялись пытки и жестокое обращение.
В 2004 году к сроку было добавлено ещё 3 года лишения свободы за «разжигание сепаратизма» после того, как Джигме Гьятсо выкрикивал лозунги в поддержку Далай-ламы в тюрьме Драпчи. За этот инцидент он также был избит, в том числе, электрическими дубинками. В настоящий момент Джигме Гьятсо содержится в тюрьме Кушин, на окраине Лхасы, столицы Тибетского автономного региона (ТАР). После посещения узника в 2005 году Специальным Докладчиком ООН по вопросу о пытках, который призвал власти Китая освободить Джигме Гьятсо как политзаключённого, чьи показания, возможно, были получены под пытками, тюремные власти перевели его в одиночную камеру и лишили свиданий с посетителями вплоть до 2009 года.
Как результат жестокого к нему отношения, у Джигме Гьятсо развились серьёзные проблемы со здоровьем: он с трудом передвигается и почти не слышит, а из-за проблем с кишечником и повышенного кровяного давления в 2009 году он был на протяжении несколько недель госпитализирован.
Ниже вы увидите обращение к властям Тибетского автономного региона КНР – председателю народного правительства, президенту Верховного народного суда, верховному прокурору, главе департамента юстиции, а также к премьер-министру КНР и председателю государственной комиссии КНР по этническим вопросам – с требованием освободить из заключения Джигме Гьятсо.

Уважаемый господин Посол!
Я узнал о тяжёлой ситуации, в которой находится активист движения за независимость Тибета Джигме Гьятсо, и я и обеспокоен его судьбой. Хочу обратить Ваше внимание, что он находится в тюрьме с марта 1996 года, и что к нему, по всей видимости, неоднократно применялись пытки и жестокое обращение как на протяжении расследования его дела, так и во время отбывания им более чем 15-летнего срока наказания. По последним известным мне данным, Джигме Гьятсо содержится в тюрьме Кушин, недалеко от Лхасы.
По сведениям Amnesty International, признания в совершении преступлений, по которым он был впоследствии осуждён (контрреволюция и подрывная деятельность), были получены от Джигме Гьятсо в камере дознания путём применения пыток. Он был арестован за свою мирную активную деятельность в поддержку прав народа Тибета на культуру, язык и вероисповедание.
Специальный докладчик ООН по вопросу о пытках, посетивший Джигме Гьятсо в тюрьме в 2005 году, призвал власти КНР немедленно отпустить узника как политического заключённого. Насколько мне известно, состояние здоровья Джигме Гьятсо сильно подорвано в результате жестокого обращения в различных пенитенциарных заведениях Тибетского автономного региона КНР.
Я прошу Вас немедленно и безоговорочно освободить Джигме Гьятсо и гарантировать, что все случаи применения к нему пыток и жестокого обращения будут тщательно расследованы и виновные будут привлечены к ответственности. Кроме того, прошу Вас позаботиться о том, чтобы Джигме Гьятсо была оказана необходимая врачебная помощь.
Я призываю Вас уважать и защищать право народа Тибета на собственную культуру, вероисповедание и язык. Я также призываю Вас провести чёткое различие в законодательстве Китайской Народной Республики в определении деятельности, подразумевающей мирную реализацию прав человека, включая свободу выражения мнений, свободу ассоциаций и собраний, и деятельности, которая признаётся на международном уровне преступными актами.
Я призываю Вас внести и интегрировать в законодательство страны чёткое определение и запрет на дискриминацию по любому признаку: основанную на расе, цвете кожи, происхождении или национальной или этнической принадлежности, как это декларируется в ст.1 Конвенции ООН против расизма.

The target of this appeal is the authorities of the Tibet Autonomous Region (TAR) of China – Chairman of the TAR People's Government, President of the TAR Higher People’s Court, Chief Procurator of the TAR People's Procuratorate, Director of the TAR Bureau of Justice, as well as the Prime-Minister of China and Chairman of the State Ethnic Affairs Commission. The appeal contains the demand to release Jigme Gyatso, a former Tibetan monk, who was arrested back in 1996 for participation in an underground organization standing for the independence of Tibet.
Torture and other ill-treatment sustained in prison have left Jigme Gyatso with trouble walking, and hearing problems. He has serious intestinal problems and high blood pressure, and was hospitalized for several weeks in 2009.
Jigme Gyatso (born in 1961) was detained by a criminal investigation unit set up specifically to investigate a bombing earlier that month in front of the regional government office. He was detained not in connection with the bombing, however, but for his activities in support of Tibetan independence, including setting up a group called “Association of Tibetan Freedom Movement,” distributing pro-independence pamphlets and posters and leading a demonstration in Lhasa in 1992.
Up until the trial, which took place six month after his arrest, Jigme Gyatso was imprisoned in Gutsa Prison, he was held in a special "interrogation cell," where he was tortured. For the rest of his time in Gutsa, his wrists and ankles were shackled. Court sentenced him as a “counter-revolutionary ringleader” to 15 years' imprisonment. During more than 13 years of imprisonment Jigme Gyatso was several times transferred from one penitentiary to another where he was tortured and ill-treated.
In May 2004 Jigme Gyatso was given an additional sentence of three years. He was given this for "inciting separatism" after he shouted pro-Dalai Lama slogans in Drapchi Prison. For this, he was also beaten, some of the time with electric batons on his back and chest. He is currently held in Qushui Prison, on the outskirts of Lhasa, capital of the Tibet Autonomous Region (TAR). The UN Special Rapporteur on Torture visited him in prison in 2005, and he appealed to the Government of China that Jigme Gyatso be released since he had been convicted of a political crime, possibly on basis of information extracted by torture. Following that visit Jigme Gyatso is said to have been held in solitary confinement, and not allowed visitors, until 2009.

• Call on them to introduce and integrate in domestic laws a clear definition and prohibition of discrimination on all grounds referred to in article 1 of the UN Convention against Racism, based on race, colour, descent, or national or ethnic origin.

I have learned about the dare situation in which Jigme Gyatso, the Tibet independence supporter, had found himself, and I am preoccupied with his destiny. I would like to attract your attention that he has been held in prison since March 1996 where he apparently was repeatedly tortured and ill-treated, equally during the investigation of his case and during his more than 15 years-long prison term. To the best of my knowledge, Jigme Gyatso is currently held in Qushui Prison, on the outskirts of Lhasa
According to Amnesty International, the confessions in crimes with which he was subsequently charged (counter-revolutionary and subversive activities), could have been extracted from Jigme Gyatso in the “interrogation cell” by torture. He was arrested for his activism in support of the peaceful rights of the people of Tibet to maintain their own culture, speak their language and freely practice religion.
The UN Special Rapporteur on Torture, who visited Jigme Gyatso in prison in 2005, appealed to the Government of China that he be immediately released. As far as I know, the health of Jigme Gyatso has dramatically deteriorated due to ill-treatment in different penitentiaries of the Tibet Autonomous Region (TAR) of China.
I appeal to you to release Jigme Gyatso immediately and unconditionally, to order a full and impartial investigation into allegations that Jigme Gyatso has been tortured, and bring those responsible to justice. Moreover, I plead to secure that Jigme Gyatso is provided the necessary medical assistance.
I appeal to the country authorities to respect and protect the right of Tibetans to enjoy their own culture, to practice their religion, and to use their own language. There should also be made a clear distinction in the law of the People's Republic of China between activities that involve peaceful exercise of human rights, including freedom of expression, association and assembly, and those that would be internationally recognized as criminal acts.
